[ARCHIVED] New Tobacco Laws & Information for Tobacco Retailers: Date of Record: December 16, 2019

On December 11, 2019, the state’s Public Health Council approved new regulations, 105 CMR 665, that restrict the sale of nicotine vaping and flavored vaping and tobacco products. This action follows the Legislature passing and Governor Charlie Baker signing into law An Act Modernizing Tobacco Control, which regulates access to tobacco and electronic nicotine delivery systems, including vapes. With the actions taken December 11, 2019, the Governor’s temporary statewide ban on the sale of tobacco and vape products in place since September 24, 2019 is no longer in effect. 

TIMELINE and KEY DATES:

1)  No retailers (except smoking bars) can sell flavored vaping products (including mint and menthol) starting 12/11/19.

2)  End to the statewide ban on the sale of tobacco and vape products starting 12/11/19.

3)  No retailers (except smoking bars) can sell any flavored tobacco products (including mint and menthol) starting 06/01/20.

4)  75 percent excise tax on the wholesale price of nicotine vaping products, in addition to the state’s 6.75 percent sales tax starting 06/01/20.
